Terms of Service

1. Acceptance of terms

By creating an account or using the YardVision platform (“Service”), you agree to these Terms of Service (“Terms”). If you are accepting on behalf of a company, you represent that you have authority to bind that company to these Terms. If you do not agree, do not use the Service.

2. Description of the service

YardVision provides a white-label AI yard design platform that landscaping companies (“Subscribers”) embed within their own customer-facing operations. The platform enables homeowners to upload yard photos, select services, and generate AI design visualizations, resulting in structured quote requests delivered to the Subscriber. YardVision also provides a CRM-style admin interface for managing those quote requests.

3. Accounts and eligibility

• You must be at least 18 years old and legally able to enter contracts to create an account.
• You are responsible for maintaining the security of your account credentials. Do not share your password.
• You are responsible for all activity that occurs under your account.
• You must provide accurate, current information when registering and keep it updated.
• You may not create accounts for competitors, resell access, or share login credentials with users outside your organization.

4. Subscriptions and billing

YardVision is a subscription service billed monthly. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

• Free trial: New accounts receive a 7-day free trial. No credit card is required to start. After the trial, access requires an active subscription.
• Payment: All payments are processed by Stripe. Prices are in USD and exclusive of any taxes, which are your responsibility.
• Plan limits: Each plan includes a monthly AI design generation limit. Exceeding the limit suspends generation until the next billing cycle or an upgrade.
• Upgrades / downgrades: Plan changes take effect at the next billing cycle. Upgrades apply immediately and are prorated.
• Cancellation: You may cancel at any time from the Billing page. Access continues through the end of the current paid period. No refunds are issued for unused portions of a billing period.
• Price changes: We may change subscription prices with 30 days' notice to your account email. Continued use after the effective date constitutes acceptance.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Upload content that is defamatory, obscene, infringing, or harmful
• Attempt to reverse-engineer, decompile, or extract the AI models or proprietary algorithms
• Use automated tools to scrape data from the platform
• Interfere with or disrupt the Service or its infrastructure
• Misrepresent your identity or impersonate another company or person
• Share access credentials or resell or sublicense the Service

6. Content and intellectual property

Your content: You retain ownership of all content you upload (yard photos, logos, company information). By uploading, you grant YardVision a limited license to process and display that content solely to provide the Service.

AI-generated designs:AI-generated yard design images produced using your homeowners' photos are provided for informational and sales purposes. You may use them to support your business. We do not claim ownership of generated outputs.

YardVision IP:The platform, software, documentation, and all YardVision branding are our intellectual property. These Terms grant you no license to reproduce, distribute, or create derivative works from YardVision's technology or brand assets.

7. Privacy and data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the collection and use of information as described in the Privacy Policy.

As a Subscriber, you are responsible for ensuring your homeowner customers have appropriate notice that their data is being processed through the YardVision platform. You should provide a privacy notice on any page where your customers interact with the YardVision-powered experience.

8. Service availability and uptime

We aim for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances outside our control. AI generation availability depends on third-party AI providers and may be affected by their outages. We will make reasonable efforts to notify you of planned maintenance.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AI-GENERATED DESIGNS ARE APPROXIMATE VISUALIZATIONS AND SHOULD NOT BE RELIED UPON AS PRECISE PLANS, ENGINEERING DRAWINGS, OR GUARANTEED OUTCOMES. ACTUAL RESULTS MAY VARY.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YARDVISION'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL SUBSCRIPTION FEES YOU PAID IN THE 3 MONTHS PRECEDING THE CLAIM, OR (B) $100. IN NO EVENT SHALL YARDVISION BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Termination

We may suspend or terminate your account immediately if you materially breach these Terms, fail to pay fees when due, or if we determine (in our sole discretion) that your use poses a risk to the platform or other users. Upon termination, your right to access the Service ends. We will retain your data for 90 days before deletion, during which you may request an export.

12. Changes to these terms

We may update these Terms from time to time. We will notify active Subscribers by email at least 14 days before material changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Denver, Colorado.
